1.Acceptance of these Terms

These Terms of Use and Risk Disclosure (the “Terms”) are a binding agreement between you and the operator of apematch.fun (“ApeMatch”, “we”, “us”, “our”). They govern your access to and use of the website at apematch.fun, its features, data and tools, including the swipe feed, safety scores, charts, trading terminal and quick wallet (together, the “Service”).

By clicking “I agree”, ticking the confirmation boxes, or using the Service in any way, you confirm that you have read, understood and accepted these Terms. If you do not agree, do not use the Service.

2.Eligibility: 18+ and where you live

• You must be at least 18 years old and have reached the age of majority, and the legal capacity to enter into a binding contract, in your place of residence. If the legal age for using cryptoasset services where you live is higher than 18, that higher age applies.
• You must not use the Service if you are located in, resident in, or a national of a country or region that is subject to comprehensive sanctions, or if you are on any sanctions or restricted-party list (including those maintained by the United Nations, the European Union, the United Kingdom or the United States).
• You must not use the Service where accessing cryptoasset information, trading memecoins or using decentralised trading tools is illegal or restricted. You are solely responsible for knowing and following the laws that apply to you. We make no claim that the Service is appropriate or available in any particular location.
• If you use the Service on behalf of a company or other entity, you confirm that you are authorised to accept these Terms on its behalf.

3.What apematch.fun is (and isn't)

apematch.fun is an information and interface tool. It displays tokens launched on pump.fun and related Solana venues, shows data from public sources, and lets you prepare blockchain transactions that you sign yourself.

• We are not an exchange, broker, dealer, custodian, investment adviser, fund, bank or money-transmission service, and we do not provide any regulated financial service.
• We do not create, issue, list, sponsor, endorse, vet or guarantee any of the tokens shown in the Service.
• We do not hold, control or have access to your funds, tokens or private keys, and we are not a party to any trade you make.
• Data in the Service comes from third parties (such as pump.fun, PumpPortal, Jupiter, DexScreener, GeckoTerminal, RugCheck and Solana RPC providers). It can be delayed, incomplete or wrong, and we do not verify it.
• Features such as the “safety score”, “Looks clean”, “match”, risk flags and similar labels are automated heuristics. They can and do miss scams, rug pulls, hidden supply, bundled wallets and other risks. They are not audits, ratings, endorsements or recommendations.

4.No financial advice

Nothing in the Service is financial, investment, legal, tax or other professional advice, and nothing is an offer, solicitation or recommendation to buy, sell or hold any token. Swiping, liking, “matching”, scores, charts, rankings, posts by us or by our community, and any other content are for entertainment and general information only.

You make your own decisions and are solely responsible for them. Do your own research and, where appropriate, consult a qualified independent adviser before making any financial decision. No relationship of trust, agency, partnership or fiduciary duty is created between you and us.

5.Risk disclosure

Trading memecoins is extremely risky and is not suitable for most people. By using the Service you acknowledge and accept, among others, the following risks:

• Total loss. Memecoins usually have no intrinsic value, no underlying business, no cash flows and no backing. Their price can fall to zero at any moment and many do, often within minutes of launch. Only use money you can afford to lose entirely.
• Extreme volatility. Prices can move by large percentages in seconds. Past performance, charts and market caps say nothing reliable about the future.
• Scams and manipulation. Rug pulls, honeypots, insider and bundled buys, snipers, wash trading, pump-and-dump schemes, fake social accounts, impersonation and copycat tokens are common. Creators and large holders can sell their tokens at any time.
• Liquidity and slippage. There may be no buyer when you want to sell. Thin liquidity means your trade can execute at a much worse price than shown.
• Irreversible transactions. Blockchain transactions cannot be reversed, cancelled or refunded. Sending to the wrong address, approving the wrong transaction or trading the wrong token means permanent loss.
• Technology risk. Smart contracts, bonding curves, wallets, RPC nodes, bridges and the Solana network can fail, be congested, be exploited or behave unexpectedly. Transactions can fail and still cost fees.
• Third-party risk. pump.fun, PumpPortal, Jupiter, wallet providers and data providers can change, fail, censor transactions or shut down, outside our control.
• Regulatory risk. Laws on cryptoassets are changing. New rules or enforcement may restrict your ability to hold, trade or use tokens, or make the Service unavailable.
• Information risk. Coin names, images, descriptions and social links are written by anonymous creators and may be false, misleading or offensive.

This list is not exhaustive. You use the Service entirely at your own risk.

6.The community token

A memecoin may exist that uses the ApeMatch name, branding or imagery, or that we or our community promote (any such token, the “Community Token”). You acknowledge that:

• It is not tied to the project. The Community Token is a separate, standalone memecoin for entertainment purposes. It is not connected to the Service, its development, its revenue or its future. Holding it gives you no access, features, discounts or benefits on apematch.fun.
• It gives you no rights. It does not represent equity, ownership, a share of profits or revenue, interest, dividends, voting or governance rights, a debt, a claim on any asset, or any right against us or anyone else.
• No promises. We make no promise or representation about its price, value, liquidity, listings, buybacks, burns, roadmap or utility, and we have no obligation to support it in any way. It is not an investment contract and you should not buy it expecting profit from our efforts.
• We may sell at any time. The people who operate or are associated with apematch.fun (including developers, team members, affiliates and partners) may hold the Community Token and any other token shown in the Service, and may buy, sell, transfer or otherwise deal in it at any time, in any amount, without notice to you. These transactions may affect the price. Unless we have explicitly announced an on-chain lock with a verifiable link, assume no tokens held by us are locked.
• Impersonation. Other people may launch tokens using our name or logo. Treat any token as unofficial unless we have published its exact contract address through our official channels, and even then the points above apply.
• The Service may continue, change or shut down regardless of what happens to the Community Token, and the Community Token may continue to trade regardless of what happens to the Service.

7.Coins created by third parties

Almost every token in the Service is created by anonymous third parties through pump.fun or similar launchpads. Appearing in the feed, being “liked”, “matched”, scored well, or shown in any list does not mean we approve of, have reviewed, or are connected to a token or its creator. We do not control token creators and are not responsible for their conduct, their tokens, or their names, images and links, some of which may be offensive or misleading.

8.Wallets, keys and transactions

• Non-custodial. Every transaction is signed by your own wallet. We never receive your private key or seed phrase and cannot move, freeze, recover or refund your assets.
• Quick wallet. If you create a “quick wallet”, its private key is generated in and stored only in your browser on your device. Anyone with access to your device, browser profile or malicious extensions may be able to take it. Clearing your browser data, switching devices or losing your device deletes it. Back up the key yourself; if you lose it, your funds are gone and we cannot help. Keep only small amounts in it.
• External wallets. Wallets such as Phantom, Solflare and Backpack are provided by third parties under their own terms. We are not responsible for them.
• Check before you sign. You are responsible for reviewing every transaction (token, amount, slippage, fees) before approving it. One-tap and instant-trade features execute without additional confirmation; use them only if you accept that.

9.Trading, fees and third-party services

• Trades are built by third-party services, mainly PumpPortal (which currently charges a 0.5% fee per trade) and Jupiter. pump.fun, liquidity pools and the Solana network charge their own fees, including priority fees. Fees can change without notice and are generally non-refundable, including on failed transactions.
• We are not a party to any trade. Your use of third-party services is governed by their terms, and we are not responsible for their availability, pricing, execution, errors or losses.
• Prices, market caps, estimates and balances shown in the Service are indicative only. The final result of a trade is determined on-chain.

10.Prohibited use

You agree not to:

• use the Service for any unlawful purpose, including fraud, money laundering, terrorist financing or sanctions evasion;
• engage in market manipulation, including pump-and-dump schemes, wash trading, spoofing or coordinated deception of other users;
• impersonate apematch.fun, our team or anyone else, or claim that a token is endorsed by us when it is not;
• scrape, overload, attack, reverse engineer or interfere with the Service, its servers or its data providers, or bypass rate limits or security measures;
• use the Service if you are not eligible under section 2, or help anyone else do so.

11.Taxes

You are solely responsible for determining, reporting and paying any taxes that apply to your transactions. We do not provide tax advice or tax reports.

12.Content and intellectual property

The apematch.fun name, logo, design and software belong to us or our licensors. You may use the Service for your personal, non-commercial use under these Terms. Token names, images and descriptions belong to their respective creators. If you believe content in the Service infringes your rights, contact us (section 20) and we will review it.

13.Privacy

• We do not require an account, name or email to use the Service.
• Your preferences, liked and passed coins, settings and any quick-wallet key are stored in your own browser (local storage). They are not sent to us, except that public wallet addresses are used to fetch balances and build transactions.
• Our hosting and security providers (including Cloudflare) process technical data such as IP addresses, browser information and request logs to deliver and protect the Service. Requests for coin data and transactions are passed to the third-party services named above.
• We do not sell personal data. Your on-chain activity is public by nature and can be seen by anyone.

14.No warranties

The Service is provided “as is” and “as available”, with all faults and without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, security and non-infringement. We do not warrant that the Service or its data will be accurate, complete, timely, uninterrupted, secure or error-free, or that any risk flag or score will detect any particular risk.

15.Limitation of liability

To the fullest extent permitted by law, apematch.fun, its operators, developers, team members, affiliates and partners will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, tokens, cryptoassets, funds, data or goodwill, arising out of or related to the Service, any token, any trade, any third-party service, or these Terms, however caused and even if advised of the possibility.

To the fullest extent permitted by law, our total liability for all claims relating to the Service or these Terms is limited to one hundred US dollars (US$100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud or, where applicable, for death or personal injury caused by negligence. If you are a consumer, you keep any mandatory rights you have under the consumer protection laws of your country of residence.

16.Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless apematch.fun, its operators, developers, team members, affiliates and partners from any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of your use of the Service, your trades, your breach of these Terms, or your violation of any law or third-party right.

17.Changes, suspension and termination

• We may change, add or remove any feature, or suspend or discontinue the Service, at any time and without notice or liability.
• We may update these Terms. The “Last updated” date shows the latest version. If we make material changes, we may ask you to accept the new version before you continue. Continuing to use the Service after an update means you accept it.
• We may restrict or block access for anyone we reasonably believe is breaching these Terms or the law. Sections 4 to 6 and 14 to 19 survive any termination.

18.Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the operator of apematch.fun is established, without regard to its conflict-of-law rules, except where the mandatory laws of your country of residence apply. Before starting any formal proceedings, you agree to contact us first and try to resolve the dispute informally for at least 30 days. To the extent permitted by law, disputes will be resolved individually and not as part of a class, collective or representative action.

19.General

• These Terms are the entire agreement between you and us about the Service and replace any prior statements about it.
• If any part of these Terms is found invalid or unenforceable, that part is limited or removed to the minimum extent necessary, and the rest remains in full effect.
• Our failure to enforce any right is not a waiver of it.
• You may not transfer your rights under these Terms. We may transfer ours, for example in connection with a sale or reorganisation of the Service.
• We are not responsible for delays or failures caused by events outside our reasonable control, including network outages, attacks, third-party failures or changes in law.
• If these Terms are translated, the English version prevails.
